These Terms of Service ("Terms") govern your use of the FlyBys mobile application and related services ("Service"). By using FlyBys, you agree to these Terms.

1. Service Description

FlyBys is a property intelligence platform that uses Google Maps satellite and street-level imagery combined with AI analysis to generate property assessment reports. The Service provides:

• AI-powered property condition assessments (roof, vegetation, perimeter)
• Risk scoring and grading (0-100 scale, A-F grade)
• Solar potential analysis via Google Solar API
• Opportunity identification (ADU potential, extensions, drainage)
• Property organization via saved lists
• Downloadable PDF property reports

2. Account Registration

• You must be at least 13 years old to use FlyBys
• You must authenticate using Google or Apple sign-in
• You are responsible for maintaining the security of your account
• You must provide accurate information during registration

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access properties or data belonging to other users
• Reverse engineer, decompile, or disassemble the Service
• Use automated tools to scrape or bulk-access the Service
• Redistribute or resell property reports without authorization
• Use the Service to harass, stalk, or violate any person's privacy

4. AI Analysis Disclaimer

FlyBys property reports are informational only and are not a substitute for professional inspection, appraisal, or assessment.

• AI analysis is based on available satellite and street-level imagery, which may be outdated
• Scores and assessments are estimates and may not reflect current property condition
• Solar potential data is provided by Google Solar API and is subject to Google's own accuracy limitations
• You should always conduct a professional inspection before making property decisions
• We do not guarantee the accuracy, completeness, or reliability of any analysis

5. Pricing and Purchases

• Complimentary reports: 3 free reports on account creation
• Report credits: Starting at $1 per report, available in bundles (5, 12, 35, 80, 200 credits) with volume discounts up to 50%
• Credits never expire and are non-refundable once used
• Purchases are processed through Apple App Store or Google Play
• Refund requests should be directed to the respective app store

6. Intellectual Property

• The FlyBys name, logo, and branding are our intellectual property
• The AI analysis methodology and scoring algorithms are proprietary
• Google Maps imagery is provided under Google Maps Platform Terms of Service and may not be cached, stored, or redistributed
• Property reports generated for your account are licensed to you for personal and professional use

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

• We strive to maintain service availability but do not guarantee uninterrupted access
• We may perform maintenance that temporarily affects service availability
• Analysis results depend on Google Maps imagery availability, which varies by location
• We reserve the right to modify or discontinue any feature with reasonable notice

9. Termination

• You may delete your account at any time through the app or by contacting support
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy
• Unused credits are non-refundable upon account termination

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYBYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in California.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.

Opt-Out: You may opt out of arbitration by emailing support@flybys.io within 30 days of creating your account.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms and updating the "Last updated" date. Continued use of the Service constitutes acceptance of updated Terms.
